Terms of Service

These Terms of Service (the “Terms”) govern your use of the products and services operated by Nomadic Futures, Inc. (“Nomadic Futures”, “we”, “our”, or “us”), a Delaware corporation, including the szn service available at theszn.ai (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

szn is an AI-powered personal assistant. You describe a task in your own words — booking a table, scheduling an appointment, getting a quote from a contractor — and the Service works to complete it on your behalf. To do that, the Service may place phone calls, send emails, and send text messages to third parties such as restaurants, clinics, salons, and other businesses, acting as your agent and at your direction.

The Service uses automated systems, including large language models. Output can be incomplete or incorrect. You remain responsible for reviewing anything the Service arranges on your behalf.

2. Eligibility and Accounts

• You must be at least 18 years old to use the Service.
• You must provide accurate account information and keep it current.
• You are responsible for activity that occurs under your account.
• You may not share your account credentials with anyone else.

3. Your Authorization to Act on Your Behalf

When you ask the Service to contact a third party, you authorize us to communicate with that third party as your agent for the purpose of completing the task you requested. You confirm that you have the right to provide any contact information you give us, and that you are not directing the Service to contact anyone for a purpose that would violate these Terms or applicable law.

Consent for outbound communications is captured per channel in your account settings. You can withdraw that consent at any time in your settings, which stops the Service from making further outbound contacts on your behalf through that channel.

4. Acceptable Use

Your use of the Service is subject to the szn Acceptable Use Policy, which is incorporated into these Terms. In particular, you may not use the Service to send unsolicited bulk or marketing messages, to harass or defraud anyone, to impersonate another person or organization, or for any unlawful purpose.

5. SMS and Text Messaging Program Terms

This section applies to text (SMS/MMS) messages sent or received through the Service. By providing your mobile number or by directing the Service to send a text message, you agree to these messaging terms.

What messages you may receive

• If you are a szn user: account and service notifications, task status updates, replies to messages you send us, and requests for information needed to complete a task you asked for. These are transactional messages tied to your use of the Service.
• If you are a business a szn user asked us to contact: conversational, transactional messages relating to a specific request from that user — for example, asking about availability for a reservation, confirming an appointment, or following up on a phone call you asked us to follow up on by text. We identify who we are and who we are calling for at the start of the conversation.

We do not send marketing, promotional, or advertising text messages, and we do not send bulk or broadcast campaigns.

How consent works

Our full opt-in disclosure, including a description of the in-product consent step, is published at nomadicfutures.ai/sms-opt-in.

szn users provide their mobile number and grant messaging consent in their account settings. Businesses we contact on a user's behalf receive individually composed, conversational messages tied to a specific request from that user; we do not add them to any list, and we honor opt-out requests immediately and permanently as described below.

Carriers

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.

Devices and changes to your number

Not all mobile devices or handsets may support the messaging features described here. You agree to notify us if you change or deactivate the mobile number associated with your account.

Privacy

Information collected through the messaging program is handled as described in our Privacy Policy. We do not sell, rent, or share mobile phone numbers, text messaging opt-in data, or consent with any third party for marketing or promotional purposes.

6. Voice Calls

The Service places outbound phone calls on your behalf using an AI voice agent. Calls may be recorded and transcribed so that we can complete your task, keep you informed of what happened, and improve reliability. Where recording requires notice or consent, we provide it. If a person on a call asks whether they are speaking with an AI, our agent answers honestly.

7. Fees and Billing

Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. We will give notice before any change to pricing takes effect for your plan.

8. Intellectual Property

The Service, including its software, design, and content, is owned by Nomadic Futures and protected by intellectual property law. These Terms do not transfer any ownership to you. You retain ownership of the content you submit; you grant us a license to use it as necessary to operate and provide the Service.

9. Third-Party Services

The Service integrates with third-party providers for infrastructure, AI processing, telephony, messaging, email, and payments. Your use of a connected third-party account is also governed by that provider's terms.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any task will be completed successfully.

11. Limitation of Liability

To the maximum extent permitted by law, Nomadic Futures will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, or data, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Nomadic Futures from any claim or demand arising out of your use of the Service, your violation of these Terms, or your violation of the rights of a third party.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, or if we are required to do so by law.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will provide notice through the Service or by email. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware.
